• Your access to and use of CSC Sathi (Software Development & Designing) is subject exclusively to these terms and conditions. You will not use the software for any purpose that is unlawful or prohibited by these terms and conditions. If you do not accept these terms and conditions you must immediately stop using the software else it will be termed as your acceptance.
• CSC Sathi will carry out work only where a written purchase order is provided by mail.
• QUOTATIONS AND ESTIMATES
• All quotations and estimates provided by CSC Sathi are valid for a period of 15 days from date of issue. Quotations not accepted after this timeframe must re-issue.
• All quotations are required to be accepted using the supplied Quotation Acceptance Form and returned to CSC Sathi within the 30 day period from date of issues.
• All quoted prices, excluding where indicated, do not include goods and services tax.
• Estimates may be provided by CSC Sathi to offer the client a guide on the projected costing of a project prior to any discovery or research for said project. All estimates will be clearly marked as such and are not an indication of the exact final cost to develop the application.
• All estimates will need to be formalized to a quotation or invoice before acceptance by either party as the final cost of the application.
• CSC Sathi reserves the right to suspend the services/quotation at any time, without any prior information.
• PAYMENT TERMS
• All quotations provided by CSC Sathi, require a 100% deposit upon acceptance. Unless prior arrangement has been made, final payment is strictly net 5 days from the date of completion.
• Any cost arising from payment clearings or transaction charges are solely the responsibility of the client and will be charged as such.
• CSC Sathi will only commence work on the quoted application once any deposited funds have cleared.
• The customer will not be entitled for any service in case of delay in payment for more than 5 days from the final date of project / module completion.
• If opted for service beyond the 12 months of maintenance period or as agreed by CSC Sathi, The Annual Maintenance Charges (AMC) will be normally applicable 20% (PERCENT) of original development cost of Project / Module; each year the development cost for new modules will be added to the initial development cost for the calculation of the AMC.
• The AMC percentage shall be decided by the CSC Sathi; which depends upon the amount of efforts and work required. This % may vary each year.
• The recurring / renewal amount of the domain and hosting are subjected to change as per the market rates.
• CSC Sathi doesn’t accept refund or cancellation request once software being lived.
• CSC Sathi Pvt. Ltd Reserves the Right To:
• WEBSITE DESIGN
• Though every effort will be made to ensure that the website and any work done by us is free of errors but CSC Sathi cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it. The web server, website, graphics and any programming code remain the property of CSC Sathi until all outstanding accounts are paid in full. Any work done (unless specifically agreed) by CSC Sathi remain the copyright of CSC Sathi and may only be commercially reproduced or resold with the permission of CSC Sathi.
• CSC Sathi will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.
• CSC Sathi will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.
• DATABASE, APPLICATION AND MOBILE RECHARGE & E-COMMERCE DEVELOPMENT
• CSC Sathi cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
• WEBSITE HOSTING
• Whilst CSC Sathi offers hosting of websites, no guarantees can be made as to the availability or interruption of this service by CSC Sathi cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service.
• CSC Sathi reserves the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial. Fees relating to web hosting or domain names must be paid prior to the expiration date of the said service. If the fees remain unpaid at the time of expiration, CSC Sathi can cancel the said service and not liable for any data lost as a result of the cancellation.
• COPYRIGHT
• All copyright, trademarks and all other intellectual property rights in the website and its content (including without limitation the website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to CSC Sathi or otherwise used by CSC Sathi as permitted by law.
• DISCLAIMERS AND LIMITATION OF LIABILITY
• CSC Sathi will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the website.
• CSC Sathi makes no warranty that the functionality of the website will be uninterrupted or error free, that defects will be corrected or that the website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
• PAYMENT OF ACCOUNTS
• It is the CSC Sathi that any outstanding accounts for work carried out by CSC Sathi or its affiliates are required to be paid in full, no later than 15 days from the date of the invoice unless by prior arrangement with CSC Sathi. If accounts are not settled or CSC Sathi has not been contacted regarding the delay, access to the related website may be denied. Fees relating to web hosting or domain names must be paid prior to the expiration date of the said service. If the fees remain unpaid at the time of expiration, we will with immediate effect, cancel said service and any data held by said service will be removed.
